How to choose your trademark class

The Nice Classification (45 classes) is an international system used by India's Trade Marks Registry. You must file in every class that covers your goods/services. Filing in wrong classes can leave your mark unprotected in key areas.

Multi-class filing

If your business spans multiple classes (e.g., both clothing Class 25 and retail services Class 35), you must file in each class and pay the fee for each.

Startup discount

Individuals, startups, and small enterprises pay ₹4,500/class (e-filing) vs ₹9,000 for companies. Apply via IP India's online portal at ipindia.gov.in.

TM-A application

File Form TM-A. The mark is published in the Trade Marks Journal after examination. Third parties have 4 months to oppose. If unopposed, registration is granted.

Frequently asked questions

How long does trademark registration take in India?

From filing to registration typically takes 18–24 months if there are no objections or oppositions. After filing you receive an application number and can use the ™ symbol immediately. The ® symbol can only be used after registration.

What is the difference between ™ and ®?

™ (TM) can be used as soon as you file a trademark application. It indicates you are claiming the mark. ® (Registered) can only be used after your trademark is formally registered by the Trade Marks Registry. Using ® without registration is an offence.

Can I oppose someone else's trademark application?

Yes. After a trademark is examined and accepted, it is published in the Trade Marks Journal. Any person can file an opposition within 4 months of publication. Grounds include similarity to an existing mark, descriptiveness, or bad faith.

What happens if my trademark is similar to an existing one?

The registrar may issue an Examination Report citing the similar mark. You can respond with arguments for co-existence (different goods, different market) or disclaim parts of the mark. If the matter is not resolved, a hearing is scheduled.

How long is a registered trademark valid?

A registered trademark in India is valid for 10 years from the date of application. It can be renewed indefinitely in 10-year periods by paying the renewal fee. Failure to renew leads to removal from the register.
